Introduction
These Terms of Service (“Terms”) govern your use of All Ears’ website and your receipt of ear care services provided by licensed nurse clinicians. By booking an appointment, receiving services, enrolling in a membership, or interacting with All Ears at a community event, you agree to these Terms.
1. Eligibility
All Ears provides services only to individuals eighteen (18) years of age or older. By booking or receiving services, you represent that you are at least 18 years old. We do not provide services to minors. If a minor presents for services, the appointment will be declined. We may require valid government-issued identification to verify age.
For clients residing in senior living or assisted living communities, the individual receiving services must have legal capacity to consent to treatment. If a client has a legal guardian, healthcare proxy, or power of attorney, appropriate authorization documentation may be required prior to service.
2. Scope of Services
All Ears provides ear care services performed by licensed nurse clinicians. Services may include ear cleaning (which may involve the OtoSet® device and other clinically appropriate methods), ear examinations, and referrals to audiologists or other healthcare providers. Clinical decisions are made solely at the discretion of licensed clinicians. Services may be declined or referral recommended based on clinical judgment.
All Ears does not provide emergency medical services. If you experience severe pain, bleeding, sudden hearing loss, or other urgent symptoms, call 911 or seek emergency care.
3. Services in Senior Living & Assisted Living Communities
When providing services within independent living, assisted living, or other residential communities, All Ears clinicians operate independently and are not employees of the facility unless expressly stated in a separate written agreement.
Facilities may assist with scheduling or space coordination but are not responsible for clinical services provided. Clients remain responsible for payment unless otherwise arranged in writing.
All clinical decisions remain solely within the discretion of the licensed clinician.
4. Community Events & Information Booths
All Ears may participate in health fairs, educational events, or community information booths. Information provided at such events is for educational purposes only and does not constitute medical advice or establish a clinical relationship. A clinical relationship is only formed during a scheduled service appointment.
On-site event screenings, if offered, are limited in scope and do not replace a comprehensive medical evaluation.
5. Referrals
We may recommend or facilitate referrals to audiologists, ENTs, primary care providers, or other professionals. These providers operate independently and are not employees or agents of All Ears. We do not control or guarantee third-party services or outcomes.
6. Payments
Service fees are disclosed at booking or prior to service. Payment is due at the time of service unless otherwise agreed. Pricing may change at any time. Clients are responsible for confirming insurance coverage, if applicable.
7. Cancellation & No-Show Policy
Appointments must be canceled or rescheduled at least 48 hours in advance. Cancellations made less than 48 hours before the appointment may incur a late cancellation fee. Failure to attend a scheduled appointment without notice (“no-show”) may result in a no-show fee. Repeated late cancellations or no-shows may result in suspension of booking privileges. We reserve discretion to waive fees in documented emergency situations.
8. Membership Terms (If Applicable)
Membership programs are subject to separate Membership Terms, which are incorporated into these Terms of Service by reference.
Membership benefits are valid only during the applicable membership term and expire at the end of the one-year term. Unused benefits do not carry forward into renewal terms.
By enrolling in a membership program, you agree to the applicable Membership Terms in effect at the time of enrollment. Membership benefits, pricing, included services, billing frequency, cancellation procedures, and any automatic renewal terms will be disclosed prior to enrollment.
Unless otherwise stated at enrollment, memberships automatically renew at the end of each annual billing cycle until canceled in accordance with the Membership Terms. You may cancel at any time in accordance with the cancellation procedures provided at enrollment.
Membership fees are non-refundable once billed, except where required by law. Failure to maintain a valid payment method or timely payment may result in suspension or termination of membership benefits.
9. Intellectual Property
All website content, trademarks, and branding—including All Ears and OtoSet®—are owned by SafKan Health or its licensors. Unauthorized use is prohibited.
10. Disclaimers
Services and website materials are provided “as is” and “as available.” We disclaim all warranties to the fullest extent permitted by law and do not guarantee specific health outcomes.
11. Limitation of Liability
To the fullest extent permitted by law, All Ears shall not be liable for indirect, incidental, or consequential damages. Total liability for any claim will not exceed the greater of $100 or the amount paid for services in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless All Ears and SafKan Health from claims arising from your misuse of services or violation of these Terms.
13. Governing Law
These Terms are governed by the laws of the State of Delaware. Any disputes shall be resolved in Delaware. You waive participation in class actions and waive trial by jury.
14. Changes to Terms
We may update these Terms at any time. Continued use of services constitutes acceptance of updated Terms.
